1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.

The consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither their commercial nor their independent professional activity. A commercial operator is a natural or legal person or a legal partnership who concludes a legal transaction for purposes that are commercial or related to their independent professional activity.

 

2. Contracting party, conclusion of contracts, correction possibilities

The purchase contract is concluded with ANTHEC GmbH & Co. KG.

The presentation of the products in the online shop is not a legally binding offer, but rather a non-binding online catalogue. You can put our products into the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the order process. By clicking the order button, you place a binding order for the goods contained within your shopping basket. An email confirmation of receipt of your order will be sent immediately after the order has been placed.

The time at which the contract with us is concluded depends on the payment method you have chosen:

 

Pre-payment

We accept your order by sending a declaration of acceptance in a separate email within two days. This email will contain our bank details.

 

Credit card

When you place your order, you provide your credit card details and the credit card company carries out an authorisation check. After identification as a legitimate cardholder, the payment transaction will be initiated automatically and your credit card is charged when the order is placed. The contract is concluded with us when the credit card is charged.

 

PayPal, PayPal Express

During the order process you will be redirected to the website of the online provider PayPal. There you will be able to enter in your payment details and confirm the payment instruction with PayPal. After placing an order in the shop, we ask PayPal to initiate the payment transaction and thereby accept your offer.

 

Amazon Pay

During the order process you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. There you can choose the delivery address and payment method you have saved on your Amazon account and confirm the payment instruction to Amazon. You will then be redirected to our online shop where you can complete the order process. After placing an order in the shop, we ask Amazon to initiate the payment transaction and thereby accept your offer.

 

3. Contract language, contract text storage

The language used for the conclusion of the contract is German. We save the contract text and send you the order data and our terms and conditions in text format. You can view the contract text when logged in as a customer.

 

4. Delivery conditions

Shipping costs are added to the specified product prices. You can find out more about the shipping costs on the product pages.

We only ship products out. We regret that it is not possible to come and collect the goods in person.

 

5. Payment

The following payment methods are generally available in our shop:

 

Pre-payment

If you choose the pre-payment option, we will send you our bank details in a separate email and dispatch the goods after payment has been received.

 

Credit card

When you place your order, you provide your credit card details. After identification as a legitimate cardholder, the payment transaction will be initiated automatically and your credit card charged.

 

PayPal, PayPal Express

During the order process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must first be registered with PayPal, verify your access data and confirm the payment instruction to us. After placing an order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction is then automatically carried out by PayPal immediately afterwards. You will receive further information during the order process.

 

Amazon Pay

During the order process you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. In order to be able to pay the invoice amount via Amazon, you must first be registered with Amazon and authenticate the process using your access data. There you can choose the delivery address and payment method you have saved on your Amazon account, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected to our online shop where you can complete the order process. Immediately after the order is placed, we ask Amazon to initiate the payment transaction. The payment transaction is then automatically carried out by Amazon. You will receive further information during the order process.

 

6. Reservation of proprietary rights

The goods remain our property until they have been paid for in full.

 

7. Transport damage

If delivered goods have obviously been damaged in transit, please report such faults to the delivery agent as soon as possible and please contact us immediately. Failure to file a complaint or contact us will have no consequences for your legal claims and their enforcement, especially your warranty rights. However, this will help us with our own claims against the freight carrier or transport insurance company.

 

8. Warranty and guarantees

Unless otherwise expressly agreed below, the statutory responsibility for defects applies.
The following applies to used goods: if the defect occurs one year after the delivery of the goods, claims based on defects shall be excluded. Defects that occur within one year of delivery can be claimed within the legal period of limitation of two years from the delivery of goods.
The above limitations and shortened deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of fatalities, physical injuries or damage to health
• in the case of intentional or grossly negligent breach of duty or malice
• in the event of a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on which the contractual partner may regularly depend (cardinal duties)
• in the case of a guarantee promise, if agreed upon or
• insofar as the scope of product liability law applies.

9. Liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of fatalities, physical injuries or damage to health
• in the case of intentional or grossly negligent breach of duty
• in the case of a guarantee promise, if agreed upon or
• insofar as the scope of product liability law applies.
• in the event of a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on which the contractual partner may regularly depend (cardinal duties) due to slight negligence on our part, that of our legal representatives or vicarious agents. The extent of liability is limited to the damage that was foreseeable at the time the contract was concluded, the emergence of which has to be typically expected.
In addition, claims for damages are excluded.

 

10. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found here. Consumers have the option of using this platform to resolve their disputes.

To resolve disputes arising from a contractual relationship with a consumer or disputing whether such a contractual relationship exists, we are obliged to participate in dispute resolution proceedings in front of a consumer arbitration board. The German federal universal arbitration board at the Centre for Arbitration e.V., Straßburger Strasse 8, 77694 Kehl am Rhein, www.universalschlichtungsstelle.de is responsible. We will participate in a dispute resolution procedure before this point.
